We provide a cloud-based email marketing platform that enables users to create, send, and track email campaigns; manage subscriber lists; build automated email workflows; and analyze campaign performance. The Service is provided on a subscription basis, with plan tiers as described on our pricing page.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it up to date. You may not share your account with others or create accounts on behalf of someone else without authorization.
You agree not to use the Service to send unsolicited messages (spam), distribute malware, engage in phishing, or violate any applicable laws including anti-spam regulations (CAN-SPAM, GDPR, CASL). You must have explicit consent from all recipients before sending emails. We reserve the right to suspend accounts that violate these policies without prior notice.
We collect information you provide when registering and using the Service, including your name, email address, and billing information. We also automatically collect usage data such as IP addresses, browser type, pages visited, and campaign analytics. This data is used solely to provide, improve, and support the Service. We do not sell your personal data to third parties.
We retain your account data for as long as your account is active or as needed to provide services. Upon account cancellation, we will delete your data within 30 days, except where we are required to retain it by law. You may request deletion of your personal data at any time by contacting our support team.
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. If you dispute a charge, please contact support before initiating a chargeback. Failure to pay may result in suspension or termination of your account.
All content, features, and functionality of the Service — including templates, code, design, and trademarks — are owned by us and protected by intellectual property laws. You retain full ownership of the content you create and the subscriber data you upload. You grant us a limited license to process your content solely to provide the Service.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability for any claim arising from the use of the Service shall not exceed the amount you paid in the three months preceding the claim.
We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the Service at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
